General Terms & Conditions`
These Terms and Conditions pertain to all proposals, estimates, contracts, specifications, general project descriptions, assessments, project analysis, scopes of work, change orders, and written orders for changes in work unless specified otherwise. Work not covered by contract documents will not be required to be performed unless the work is explicitly approved in writing.
Scope of Services
Castellan Service Associates (CSA) agrees to provide home and auto maintenance, assessment, and project management services as requested by Client. Services will be performed in a professional and workmanlike manner.Limitation of Liability
To the fullest extent permitted by law, CSA shall not be liable for any indirect, incidental, consequential, or special damages arising from the services provided. CSA’s total liability under this Agreement shall not exceed the amount paid by Client for the specific service giving rise to the claim.The Company has no affiliation with any external service providers. The CSA has no role or stake in any agreements or business arrangements made between the Client and any external service providers.
Indemnification
Client hereby undertakes and agrees to indemnify and save harmless CSA, its officers, directors, and employees, from any and all liability, loss, damage, suits, debts, claims, expenses, etc., whatsoever, arising directly or indirectly from these Terms and Conditions or any ensuing Agreement including any patent, copyright, trade secret, or trademark infringement claims.Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state in which the services are provided.Disclaimers
The maintenance services provided by CSA do not guarantee the longevity or efficiency of the serviced equipment. Client acknowledges that regular maintenance may reduce the risk of equipment failure but does not ensure uninterrupted or improved performance.
CSA is not liable for condition or performance of existing systems, appliances, equipment, or components.
CSA is not liable for work performed by other vendors.
Assessments provided by CSA are performance-based evaluations made on the date of work performed without consideration for future performance.
Analysis provided by CSA is intended to provide the Client with additional information to support a data-driven decision and should not be considered as subject matter expert guidance.
Warranty
Work documented on the invoice is covered for thirty (30) days and is limited to services provided by a Company representative. This warranty applies only to defective materials or workmanship. Warranted items will be replaced at no charge to the customer. Mold, microbial matter, or fungal growth is not covered under this warranty.
Payment Terms
Payment is due upon completion of initial assessment and within 14 days of each service visit.
Additional products and supplies, not included with base subscription, and purchased or facilitated by the Service Provider will be billed to the Client with no mark-up or additional charges.
Contract Duration and Renewal
The Contract is valid upon signing in perpetuity, beginning on the date signed until either party wishes to terminate at any time. Written notice of termination must be provided no less than 30 days from the next scheduled service visit.
Non-Disclosure Statement
The Service Provider agrees to never disclose, discuss, or share any private, personal, or sensitive information observed while on the Client’s property, unless legally obligated.
This includes but is not limited to the appearance or layout of the home, the presence of individuals, personal items, or conversations not related to the service being performed.
